Usage of Photos
By submitting your photograph or photographs (“Your Photo(s)”) to The Jesuit Post or any other website provided by The Jesuit Post or its successors, affiliates or licensees (“The Jesuit Post”), you agree to be bound by these Terms and Conditions relating to the use of Your Photo(s) by The Jesuit Post.
You retain all ownership rights in Your Photo(s). However, by submitting Your Photo(s) to The Jesuit Post, you hereby grant to The Jesuit Post a worldwide, non-exclusive, royalty-free, sublicenseable, perpetual, irrevocable and transferable license to use, reproduce, distribute, prepare derivative works of, and display Your Photo(s) in connection with the services of The Jesuit Post, including without limitation, for promoting those services in any media formats and through any media channels.
If you appear in Your Photo(s), you hereby authorize The Jesuit Post to use your name, image, likeness or persona in connection with the promotion of The Jesuit Post. If you are submitting a photo of any other person or persons, you represent and warrant that each of those other persons has likewise consented to the use of his or her name, image and persona by The Jesuit Post. If you are submitting a photo of a child, you represent and warrant that you are either that child’s parent or legal guardian, and that you grant The Jesuit Post the right to use that child’s name, image and persona. You hereby release The Jesuit Post from any and all liability for all legal causes of action arising from or related to The Jesuit Post’ use of Your Photo(s), including, without limitation, misappropriation of the right of publicity and invasion of privacy.
You hereby warrant and represent that: (1) you own or have the right to submit Your Photo(s) to The Jesuit Post, and (2) the uses to be made of Your Photo(s) by The Jesuit Post as provided for under these Terms and Conditions will not infringe upon or violate the rights of any third party. You agree to defend, indemnify and hold harmless The Jesuit Post from any third party claims arising from the use of Your Photo(s).
The Jesuit Post shall have the sole discretion to publish Your Photo(s) or to remove Your Photo(s) after publication. The Jesuit Post shall have no obligation to pay you for its use of Your Photo(s).
Contest Deadlines
The submission deadline for photographs is midnight November 11, 2012 (Eastern Time). A panel of judges selected by the editors of The Jesuit Post will choose the finalists. Finalists will be announced on The Jesuit Post on November 14, 2012. All decisions of the judges are final. Online voting will occur from November 14-18, 2012. Contest winners will be selected based upon the results of the online voting.
General Conditions and Online Voting
In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Terms and Conditions or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision.
Communication via Social Media
This contest will be publicized on various 3rd party social media platforms including but not limited to, Facebook, Pinterest and Twitter. None of these companies or organizations is in any way responsible for the operation of this contest. Communication and publication of the contest on 3rd party social media platforms in no way indicates an endorsement of this contest by those companies. All communication between The Jesuit Post and contestants will follow the usage guidelines set by each social media platform. Following the Jesuit Post on Twitter, Pinterest or Facebook is not a requirement for entry into the contest, nor will following or liking The Jesuit Post increase your chances of winning. Photos that are submitted to the contest may be published on The Jesuit Post affiliated pages and feeds of 3rd party social media sites per the usage guidelines established above.
Contest Prizes
The potential winners will be officially notified by email or phone. Each potential Prize winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winners behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Terms and Conditions, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.
